New Mexico

If your insurer denies coverage for a gender-affirming procedure, you can:

APPEAL A DENIAL

The first step we recommend is appealing directly with your health insurer.

FILE A COMPLAINT

If your appeal is denied, we recommend you file a complain with your state's Insurance Commissioner who can fight an illegal denial of care on your behalf.

TELL HHS OCR

You can file a complaint with the U.S. Department of Health and Human Services' Office of Civil Rights.

REPORT IT TO CMS

You can report discrimination to the Centers for Medicare and Medicaid Services via email.

SUE YOUR INSURER

Finally, you may have the right to file a lawsuit against your insurer. We recommend connecting with a legal aid organization for help.

New Mexico's open enrollment period for 2025 runs

November 1, 2024

through

January 15, 2025

Please be sure to enroll by DECEMBER 15, 2024 for coverage starting JANUARY 1, 2025. If you enroll after that, your coverage may not start until the first of the following month.

If you miss out on open enrollment, you may be locked out of coverage until next year, unless you have a Qualifying Life Event that makes you eligible for a Special Enrollment Period. Examples include getting married, moving states, having (or adopting!) a child, turning 26, or losing insurance coverage due to job loss, divorce or death of the insurance policyholder. If you believe you qualify or aren't sure, you can reach out to an enrollment assister for free help.
